RICS Consults on New Party Wall Guidance: Why It Matters for Your Project

RICS has launched a consultation on the draft eighth edition of its Party Wall guidance. This is a move that is likely to influence how party wall matters are handled across residential and development projects in England and Wales.

While the Party Wall etc. Act 1996 remains unchanged, the guidance plays a critical role in shaping day to day practice. It is routinely relied upon by surveyors, advisers, and increasingly by the courts when assessing whether party wall procedures have been properly followed.

What’s Changing in Practice?

The draft guidance reflects the commercial realities of modern development and aims to tighten standards around:

  • Validity and service of notices (a frequent cause of delay and dispute);

  • Surveyor appointments and conduct, including conflicts and impartiality;

  • More proportionate awards, aligned to risk rather than box ticking; and

  • Early dispute avoidance, rather than reactive escalation.

In short: less room for error, and greater scrutiny where things go wrong.

For developers, party wall issues remain one of the most common sources of programme slippage, neighbour disputes and unexpected cost. The proposed changes underline the importance of getting party wall strategy right at the outset—especially on basement works, infill schemes and tightly constrained urban sites.
